dc.description.abstractEs tarea ineludible de los jueces justificar sus decisiones, la que resulta más compleja cuando se trata de acciones constitucionales donde se demanda la protección de derechos colectivos cuyo titular es el conglomerado social, pues la constitución política le impone la carga de hacerlo ajustado a la ley. Sin embargo los resultados de un proceso de Acción popular depende de distintas causas, incluidas en ellas la participación del actor popular que en el Circuito judicial de Bucaramanga es casi nula. En las sentencias que terminan las acciones populares los Jueces Civiles del Circuito usan principalmente argumentaciones silogísticas que tienden a favorecer la aplicación de las normas y excepcionalmente a crear derecho a través de las definiciones que sobre cada derecho colectivo que se demanda como vulnerado, siendo que el privilegiado surge de la vulneración de las normas del plan de ordenamiento territorial local en cuanto toca con la publicidad en cualquiera de sus condiciones. La argumentación de las sentencias de los Jueces Civiles del Circuito no es prolija porque no hay una verdadera depuración de los derechos colectivos en el ámbito de lo privado y las normas sobre acciones populares demandando su amparo por acciones policivas que demuestran la ineficacia estatal.
dc.description.abstractenglishIt is the judges's unavoidable task to justify their decisions, the one that is more complex when it is constitutional actions where the protection of collective rights is demanded whose holder is the social conglomerate, because the political constitution imposes him the load of making it adjusted to the law. However the results of a process of popular Action depend on different causes, included in them the popular actor's participation that is almost null in the judicial Circuit of Bucaramanga. In the sentences that finish the popular actions the Civil Judges of the Circuit they use mainly arguments silogisticas that spread to favor the application of the norms and exceptionally to create right through the definitions that it has more than enough each collective right that is demanded as harmed, being that the privileged one arises of the vulneration of the norms of the plan of local territorial classification as soon as he/she plays with the publicity in anyone of their conditions. The argument of the sentences of the Civil Judges of the Circuit is not meticulous because there is not a true purification of the collective rights in the environment of that deprived and the norms on popular actions demanding its help for actions policivas that demonstrate the state inefficacy.
