dc.description.abstractLa presente tesis de investigación estudia la labor de justicia del licenciado Juan de Montaño en su oficio como oidor de la Real Audiencia de Santa Fe, en diversos procesos que afectaron la relación entre los españoles y los indios. Para lograr esto se llevaron a cabo tres capítulos que abarcan la historia de vida del licenciado desde 1553, sus relaciones familiares, personales y su trato con los indios hasta la finalidad del proceso en 1561. El primer capítulo abarca la situación jurídica de los indios durante el proceso de conquista y consolidación del Estado Español, así como de la necesidad de implantar diversas instituciones, entre estas la de justicia. A su vez el Segundo capítulo detalla la llegada del licenciado Juan de Montaño al Nuevo Mundo, sus relaciones personales y familiares, donde se destaca su esposa Catalina de Sotomonte, así como el estudio de diversos casos en los cuales utilizó su poder y autoridad en detrimento de la población indígena. Finalmente la investigación concluye nominando casos en los cuales el oidor dio prioridad a los intereses de los españoles sobre las necesidades de los indios; así como la muerte ocasionada sobre el español Pedro de Salcedo, proceso que sería el punto de inflexión en su eventual juicio de residencia.
