dc.description.abstractEste trabajo de grado tiene un enfoque y desarrollo con el que además de recapitular sobre la teoría que nos sirve de base, aborda un problema local en particular: ¿Cuál es el régimen legal o reglamentario que regula en Colombia la Carrera Especial Registral para la garantía de la plenitud del ordenamiento jurídico? Dicho problema permite abordar la materia de las lagunas normativas, comprender el dogma de la plenitud como característica inherente a los ordenamientos jurídicos e identificar el régimen que regula la Carrera Especial Registral en Colombia. En Colombia existe un régimen general de carrera, unos regímenes específicos de carrera en razón a la singularidad y especialidad de las funciones que cumplen las entidades en las cuales se aplican, y unos regímenes especiales de carrera, para los que se tiene una determinada regulación y reglamentación. Sin embargo, respecto de la Carrera Especial Registral, entendida también como un régimen especial de carrera, recientemente creada por el legislador mediante la Ley 1579 de 2012, no se tiene certeza sobre su regulación jurídica, lo cual genera lagunas normativas que hacen que el ordenamiento no sea pleno o íntegro, se desatiendan los principios constitucionales de igualdad, mérito, moralidad, eficacia, economía, imparcialidad, transparencia, celeridad y publicidad en que se desarrolla la función pública, e impide el logro de la satisfacción de los intereses generales y de la efectiva prestación del servicio. De acuerdo con todo lo anterior, con el presente trabajo se pretende establecer de qué manera operan los mecanismos hermenéuticos para la garantía de la plenitud del ordenamiento jurídico que permitan la identificación del régimen que regula la Carrera Especial Registral en Colombia
