dc.description.abstractEl problema de los derechos humanos es cada vez más recurrente en la sociedad contemporánea; abundantes son las reflexiones, las investigaciones y losencuentros que losabordan, como también la jurisprudencia lograda hasta el presente, reflejada en acuerdos, tratados y normas que exigen su protección a nivel nacional e internacional. En oposición, aún hoy son también numerosos los casos en los que se violan las más mínimas libertades de los ciudadanos, tal como ocurre en Colombia. En primer, lugar se conceptualiza sobre los Derechos Humanos desde una perspectiva histórico-filosófica considerándolos como bienes culturales y en segunda instancia, se realiza una mirada sobre ellos en la Constitución política colombiana. Finalmente, el capítulo central aborda el problema de los Derechos Humanos desde una perspectiva Deleuziana, es decir, como una filosofía aplicada. Se intentó rastrear una crítica de Deleuze a los Derechos Humanos, pues este filósofo ve el problema de los derechos y específicamente de los Derechos Humanos como una cuestión de pura jurisprudencia, a la cual considera como la invención del derecho. Por tanto, ellos no pueden existir como dogma, sino como ideas realizadas jurisprudencialmente, o mejor aún, más que ser justificados teóricamente deben ser llevados a la práctica, jugando así un papel importante en las actuales luchas por construir una sociedad más justa y equitativa.
dc.description.abstractenglishThe problem with human rights is becoming more recurring every day in modern society; the reflections, investigations and findings that surround the issue are abundant, as well as the jurisprudence achieved up until the present day, which is reflected in treaties, deals, and norms that demand a national and international protection of the civil rights. On the other hand, even today the number of cases in which the tiniest of civilian liberties are violated, exceed in vast numbers, as it is seen in Colombia. Initially human rights are studied and taken from a historical and philosophical perspective, where they are considered a cultural good. Afterwards, the human rights are analyzed from the context of the Colombian Constitution. Finally, the central chapter interprets the problem of the human rights from a Deleuzian point of view, where they are approached as an applied philosophy. A search of Deleuze™s ideas was necessary, since this philosopher sees the problem as an issue for jurisprudence, where it is considered the invention of the law. Therefore, human rights cannot exist as an absolute truth, but as an idea made jurisprudentially, and rather than simply justify them theorically they must be taken into practice, in which they play an important role in the construction of a more just and fair society.
