dc.description.abstractLa presente investigación pretende contribuir a los estudios sobre criminalidad que se han realizado para el caso de Santander, durante el periodo de la República Liberal 1930-1946. Centrándose en el delito de aborto como un elemento del control social que ejerce el Estado a través de las instituciones judiciales que mantuvieron una estructura administrativa que develó el funcionamiento y el control con el fin de mantener el orden y la disciplina social. La creación del aborto como elemento de control social estuvo ajustado a los intereses políticos de las élites locales y nacionales por disciplinar las conductas sociales y legitimar su poder a través de instituciones jurídicas que funcionaban para vigilar, controlar y castigar a los ciudadanos que cometieran delitos. Por medio de la consulta de los expedientes judiciales por aborto ubicados en el Archivo Histórico Judicial de Bucaramanga y del análisis de fuentes publicadas como: la Gaceta Judicial, la Revista Judicial, entre otras. Se pudo crear una representación histórica del delito de aborto basado en los procedimientos judiciales y la manera cómo eran aplicadas las leyes nacionales por los funcionarios de la estructura del sistema judicial en la ciudad de Bucaramanga dentro del marco explicativo de la República Liberal. Las investigaciones por aborto se vieron interrumpidas por la ausencia de herramientas científicas, por las características del delito que no dejaba rastros ni huellas y por la influencia que tuvo el ambiente en la preservación del cuerpo del delito. Por esta razón, en algunos casos ni el dictamen médico-legal ni las investigaciones realizadas por los peritos pudieron llegar a develar si el hecho había sido producto de una acción criminal o por causas naturales.
dc.description.abstractenglishThis research aims to contribute to studies of crime have been made for the case of Santander, during the period 1930 to 1946 the Liberal Republic . Focusing on the crime of abortion as an element of social control exercised by the State through the judicial institutions that maintained an administrative structure that revealed the operation and control in order to keep order and social discipline. The establishment of abortion as an element of social control was adjusted to the political interests of local and national elites to discipline social behaviors and legitimize their power through legal institutions that worked to monitor, control and punish citizens who commit crimes. Through consulting court records by abortion located in the Historical Archive of Judicial Bucaramanga and analysis of published sources such as the Judicial Laws, Judicial Review, among others. It could create a historical representation of the crime of abortion based on court proceedings and the way national laws were implemented by officials of the structure of the judicial system in the city of Bucaramanga in the explanatory framework of the Liberal Republic. The abortion investigations were interrupted by the lack of scientific tools , the nature of the crime that left no tracks and traces the influence he had in preserving the environment of the corpus delicti . For this reason, in some cases neither legal nor medical research conducted by the experts opinion could get to reveal whether the failure was the result of a criminal act or natural causes . History
