El debate entre universalismo moral y particularismo ético aún no encuentra un punto de conciliación equilibrado. La perspectiva particularista critica al universalismo la nivelación que de las especificidades y diferencias culturales pretende, amparado en el argumento de la necesidad de una concepción universal de los derechos humanos; el enfoque universalista, por su parte, critica al particularismo que, amparándose en la defensa de la soberanía nacional y la autodeterminación política y cultural, acarree como peligrosa consecuencia, la legitimación de ciertas prácticas culturales que atentan contra los derechos y libertades básicas fundamentales. Con Reiner Forst, se nos presenta una tentativa de conciliación a este debate mediante su tesis sobre el derecho básico a la justificación, que no es otra cosa que una nueva concepción de los derechos humanos y por tanto, de la justicia.
The debate between moral universalism and ethical particularism still didn’t find a univocal point of conciliation. While the particularistic perspective is criticized the leveling of the particularities and cultural differences produced by the universalist positions, in turn this position, criticized the dangerous tendency to legitimate, from the perspective of ethical particularism, certain cultural practices that threaten the rights and basic freedoms. With Reiner Forst, presents an attempt of conciliation to this debate by his thesis on the basic right to justification, which is nothing else than a new conception of human rights and Justice.
