dc.description.abstractA lo largo de la historia de la humanidad, la cuestión que gira en torno a cuál es la forma más eficaz de castigar ha cobrado relevancia con el pasar de los años. Desde la antigüedad con los suplicios hasta la contemporaneidad con los subrogados penales como la de la suspensión condicional de la pena o la prisión domiciliaria, el debate gira en torno a cuál es la fundamentación de la pena y qué se busca con ella; retribuir el mal causado, salvaguardar a la sociedad de futuros delitos o curar a la persona para que no vuelva a delinquir. La mirada abolicionista de Foucault cobra relevancia en la medida que se empieza a enaltecer la dignidad humana como fundamento del nacimiento del Estado moderno y la justicia como garantía que brinda condiciones adecuadas para la convivencia humana. “Vigilar y castigar” nos presenta un barrido histórico-filosófico que nos sirve de primer paso para analizar este aspecto y para hacer una lectura de las teorías fundamentadoras de la pena, esto con el fin de iniciar un camino fundado en la pregunta por qué el Estado tiene derecho a castigar, e incluso matar, a quien comete un delito.
dc.description.abstractenglishThroughout the history of mankind, the question revolving around what is the most effective form of punishment has gained relevance over the years. From ancient times with the torture to contemporary times with penal subrogations such as conditional suspension of sentences or house imprisonment, the debate revolves around what is the basis of punishment and what is sought with it: to retribute the evil caused, to safeguard society from future crimes or to cure the person so that he does not reoffend. Foucault's abolitionist view becomes relevant to the extent that human dignity begins to be extolled as the foundation of the birth of the modern State and justice as a guarantee that provides adequate conditions for human coexistence. "Discipline and Punish" presents us with a historical-philosophical sweep that serves as a first step to analyze this aspect and to make a reading of the founding theories of punishment, this in order to start a path based on the question why the State has the right to punish, and even kill, whoever commits a crime.
