dc.description.abstractEste estudio ha tomado como eje de investigación el análisis de cuatro casos de graves violaciones a los derechos humanos de comunidades históricamente excluidas, quienes fueron víctimas de Crímenes de Lesa Humanidad, en los cuales el sujeto activo que comete dicho crimen es el Estado. En los 4 casos se identificó elementos que, a la luz de los Derechos Humanos, aportan a mejorar las condiciones de reparación simbólica de las víctimas. Varios de estos elementos parten de reconocer las prácticas autónomas de las víctimas y sus comunidades para el restablecimiento de sus derechos y su proceso de dignificación. Este análisis se desarrolla a través de la comparación de casos en donde los procesos de reparación simbólica se dan de manera autónoma desde las comunidades y promovido por las víctimas, como el denominado la por la fundación Fundescodes promueven manifestaciones artísticas. El segundo, es la experiencia del grupo teatral Trvíctimas de las ejecuciones extrajudiciales Procesos que se comparan con dos casos en donde la reparación simbólica es promovida a través de senteen la solución amistosa de Herson Javier Apache asesinado por agentes del Estado. Se logra identificar que estas iniciativas autónomas pueden aportar elementos que mejoren efectivamente el desarrollo y la ejecución de los procesos judiciales, así como identificar soluciones prácticas al momento de escoger cómo se pueden articular las distintas medidas de reparación.
dc.description.abstractenglishThis study has taken as an investigation the analysis of four cases of serious human rights violations of historically excluded communities, who were victims of Crimes of Lesa Humanity, in which the active subject that commits such crime is the State. In the four cases, elements were identified that, in the light of Human Rights, contribute to improving the conditions of symbolic reparation of the victims. Several of these elements start from recognizing the autonomous practices of the victims and their communities for the restoration of their rights and their process of dignification. This analysis is developed through a comparison of cases where the processes of symbolic reparation occur autonomously from the communities and promoted by the victims, such as the "Chapel of Memory" in Buenaventura with victims of forced disappearance and Murders, which accompanied by Fundescodes Foundation promote artistic manifestations. The second is the experience of the theater group Tramaluna with the montage of the work "Antigone Court of Women", work in which act two mothers of Soacha victims of extrajudicial executions Processes that are compared with two cases where the symbolic reparation is promoted through judicial decisions of the Inter-American Court of Human Rights in the case of "19 Merchants Massacre" and in the friendly settlement of Herson Javier Apache murdered by agents of the State. It is possible to identify that these autonomous initiatives can provide elements that effectively improve the development and execution of judicial processes, as well as identify practical solutions when choosing how to articulate the different measures of reparation
