dc.description.abstractLa presente investigación aborda el problema de la organización de justicia en Santander de 1886 a 1830, especialmente del ramo penal o criminal, y la manera como esta enfrentó el proceso de reorganización de una estructura federal a una centralizada. A través de cuatro capítulos se busca, conocer el proceso de reorganización del poder judicial, tanto en nombramientos como en ajuste y cubrimiento de los gastos relacionados con estos; la influencia de la política en el nombramiento y la toma de decisiones judiciales, la efectividad de la justicia en términos de conclusión de causas y disminución de la criminalidad, así como el desarrollo de la administración de justicia antes, durante y después de la Guerra de los Mil Días. Con lo anterior se evalúa el proyecto de La Regeneración que buscaba la renovación administrativa y moral de la república, y con ello la civilización de sus instituciones que conllevara a la acción moral de los funcionarios, el castigo efectivo de los criminales y la consecuente renovación espiritual de los ciudadanos bajo la tutela de la religión y de las instituciones. Esto en confrontación con la permanente presión del liberalismo y de sectores ilustrados del conservadurismo, que buscaban implementar las teorías de la criminología italiana con el fin de modernizar la administración judicial y en especial la legislación penal, de tal manera que se modificase la percepción de una criminalidad producida por la inmoralidad de los ciudadanos a una producida por la enfermedad psicológica del individuo.
dc.description.abstractenglishThis research addresses the problem of the organization of justice in Santander from 1886 to 1830, especially the penal or criminal justice, and how this reorganization process faced a federal structure to a centralized. Through four chapters it propose, know the process of reorganization of the judiciary, both as setting appointments and coverage of expenses related to these, the influence of politics in the appointment and judicial decision making, the effectiveness of justice in terms of conclusion of causes and crime reduction, and the development of the administration of justice before, during and after the Thousand Days War. It evaluates the project of The Regeneration that was seeking the administrative and moral renewal of the republic, the civilization of their institutions; which will lead the moralization of the society, through effective punishment of criminals and the consequent spiritual renewal of citizens under the protection of religion and institutions. This in permanent confrontation with the pressure of liberalism and conservatism enlightened sectors, that was seeking to implement the theories of Italian criminology, in order to modernize the judiciary and especially criminal law, theory that changes the perception of a crime caused by the immorality of citizens to a psychological illness caused by the individual Degree
