dc.description.abstractResulta curioso entender que la oralidad en la dinámica del nuevo Sistema Penal Acusatorio no es una consecuencia de la puesta en marcha del mismo, sino que precisamente la oralidad procesal es el principal punto diferenciador del antiguo modelo inquisitivo, ya que allí la interacción entre las partes era poco representativa. Por otra parte, la tendencia acusatoria del nuevo sistema ofrece a las partes e intervinientes la posibilidad de un mayor acercamiento a través del lenguaje, que si bien, se constituía una herramienta fundamental en el abogado, ha cobrado la importancia vital en el procedimiento penal. Por ello este escrito está dividido en tres partes: Transformaciones del Sistema Procesal Penal Colombiano que son importantes para la teoría del discurso jurídico, Teoría de Los actos de habla y de auditorio como elementos connaturales al nuevo esquema procesal penal, y un acercamiento a la relación entre lenguaje y práctica procesal penal, esta propuesta implica una visión filosófica del discurrir de las audiencias producto de la implementación del nuevo sistema penal acusatorio en nuestro país, a la luz de algunas teorías de la argumentación y en general los actos de habla.
dc.description.abstractenglishIt turns out peculiar to understand that the orality in the dynamics of the new Accusatory Penal System is not a consequence of the beginning of the same, but indeed the procedural orality is the main point differentiator of the old inquisitive model, since there the interaction between the parts was little representative. On the other hand, the accusatory tendency of the new system offers to the parts and participants the possibility of a greater approach through language, that although, a fundamental tool in the lawyer was constituted, has acquired the vital importance in the penal procedure. For that reason this writing is divided in three parts: Transformations of the Procedural System Penal Colombian that are important for the theory of the legal speech, Theory of the acts of speech and audience like natural elements to the new penal procedural scheme, and an approach to the relation between language and penal procedural practice, this proposal implies a philosophical vision of reasoning of the hearings product of the implementation of the new accusatory penal system in our country, in the light of some theories of the argumentation and generally the speech acts.
