dc.description.abstractEn la actualidad, en Colombia se viene presentando el Estado de cosas Inconstitucional en las prisiones declarado por la sentencia C-128 de 1998, es de esta manera como observamos el fracaso de mencionada institución y de su principal función, la resocialización. Por lo anterior, se hace necesario dar un giro al estudio del tema, de tal manera que indaguemos el funcionamiento de este evidente fracaso (de la resocialización y de la prisión). Esto, se hará mediante la verificación histórica de la norma penal y carcelaria Colombiana desde el año de 1837; la revisión histórica y temática de la jurisprudencia emanada de las altas cortes (Constitucional, Suprema y Consejo de estado) desde el año de 1991, en lo referido a la situación penitenciaria y de dignidad humana de los detenidos; también, acudiremos a la observación de la prisión Colombiana, esto es, la observación de las condiciones y modo de vida en la cárcel . Por último, recurriremos al estudio teórico histórico y de las relaciones de poder que propone el fil respuesta desde esta perspectiva, a la pregunta de cómo funciona el fracaso de la resocialización en Colombia.
dc.description.abstractenglishCurrently, Colombia is showing up in the state of things in prisons unconstitutional , declared by the judgment C -128 of 1998 , is in this way that we see the failure of that institution and its main function , (re) socialization . Therefore, it is necessary to turn to the study of the subject, let us search so that the operation of this obvious failure (of (re) socialization and prison). This will be done through the historical verification of the Colombian penal and prison rule since 1837, the historical and thematic review of the jurisprudence emanating from the high courts (Constitutional, Supreme and State Council) since 1991, it refers to the prison and human dignity of detainees situation, too, will go to the observation of the Colombian prison, that is, observing the conditions and way of life in jail " MODEL" of the city of Bucaramanga. Finally , we will resort to theoretical study - historical , and power relations proposed by the French philosopher Michel Foucault in his book " Discipline and Punish " , so we take a response from this perspective, the question of how the failure of (re) socialization in Colombia .
