| dc.description.abstract | Con la Ley 100 se implementaron amplias modificaciones de fondo en cuanto a la seguridad social en el país y se establecieron nuevas instituciones. A partir de ella en materia de pensiones se creó el régimen de ahorro individual, se estableció el bono pensional, se crearon los fondos territoriales, se ordenó la creación de patrimonios autónomos, se fortaleció la vigilancia de la Superintendencia Bancaria, se financió la acumulación de tiempo de servicios prestados en el sector público y privado a través del bono pensional, se reconocieron las cotizaciones efectuadas antes de la ley 100 y el tiempo de los servidores públicos, se creó un régimen de transición para las mujeres de más de 35 años y hombres de más de 40 ( Art. 36 ley 100/93) y se unificaron los derechos y las obligaciones para obtención, reconocimiento y pago de pensiones. Las AFP son sociedades financieras de carácter provisional, vigiladas por la Superintendencia Financiera, cuyo objeto exclusivo es la administración y manejo de fondos y planes de pensiones del Régimen de Ahorro Individual con Solidaridad y de fondos de cesantía. En su calidad de administradoras de este régimen, se encuentran obligadas a prestar en forma eficiente, eficaz y oportuna todos los servicios relacionados con la administración de dichos fondos, los cuales deben ser invertidos en las condiciones y con sujeción a los limites que para el efecto establezca la Superintendencia Financiera, quien adicionalmente determinará la rentabilidad mínima que las AFP deben garantizar a sus afiliados; tal y como lo enuncia el artículo 99 y siguientes de la Ley 100 de 19932. | |
| dc.description.abstractenglish | Since the nineties were initiated reform processes in social security in almost every country in Latin America. Undoubtedly there were many reasons to change things, because the establishments were degraded, were economically waned, the situation was worrying considering that the contributors were affected because they receive some services that did not correspond to their expectations. The demotivated staff, planning and regulation were obsolete and the consequences were of poor quality services, poorly distributed geographically and misguided in relation to people's needs. With the Act 100 amendments were implemented extensive background on social security in the country and created new institutions. From there on pensions was set up individual savings scheme, it established the pension bond, were created territorial funds, was ordered the creation of autonomous assets, strengthened the surveillance of the Banking Superintendence, was financed accumulation Time of services provided in public and private sectors through the pension bond, recognized the contributions made before the law 100 times and public servants, creating a transitional regime for women over 35 years and men over 40 (Art. 36 law 100/93) were combined and the rights and obligations for procurement, recognition and payment of pensions.
