dc.description.abstractEl fenómeno del despojo urbano en el Departamento de Norte de Santander ha emergido como una problemática de significativa relevancia, manifestándose a través de las sentencias proferidas por el Tribunal Superior del Distrito Judicial de Cúcuta entre los años 2012 y 2020, en el presente escrito se analizará el despojo urbano, teniendo como fuente principal esas sentencias. Este fenómeno no solo constituye un desafío para el desarrollo urbanístico y social de la región, sino que también plantea interrogantes cruciales sobre la equidad, la justicia y la protección de los derechos fundamentales de los ciudadanos. Las decisiones judiciales, como reflejo de la realidad sociopolítica, han delineado un panorama complejo en el que la tenencia y disposición de la tierra han sido objeto de controversias legales que han impactado directamente en la vida de las comunidades locales. Este análisis propone explorar la importancia de comprender y abordar el despojo urbano en el Departamento de Norte de Santander, examinando las sentencias emitidas por el Tribunal Superior del Distrito Judicial de Cúcuta como piezas clave para entender las dinámicas y los actores armados que incidieron en ese hecho victimizante, en última instancia, se busca contribuir a la conciencia pública en especial de la región.
dc.description.abstractenglishThe phenomenon of urban dispossession in the Department of Norte de Santander has emerged as a problem of significant relevance, manifesting itself through the sentences handed down by the Superior Court of the Judicial District of Cúcuta between 2012 and 2020. In this paper, urban dispossession will be analyzed, having as the main source these sentences. This phenomenon not only constitutes a challenge for the urban and social development of the region, but also raises crucial questions about equity, justice and the protection of the fundamental rights of citizens. Judicial decisions, as a reflection of the sociopolitical reality, have outlined a complex panorama in which land ownership and disposition have been the subject of legal controversies that have directly impacted the lives of local communities. This analysis proposes to explore the importance of understanding and addressing the urban dispossession in the Department of Norte de Santander, examining the sentences issued by the Superior Court of the Judicial District of Cúcuta as key pieces to understand the dynamics and the armed actors that affected that victimizing fact, ultimately, it seeks to contribute to public awareness, especially in the region.
