| dc.description.abstract | El desarrollo del ser humano ha implicado para éste el perfeccionamiento de las relaciones que sostiene con otros seres de su misma especie, dirigiéndolas mediante el Derecho pero de acuerdo a una base llamada economía; es esa base la que ha modificado las relaciones humanas, pues es ella la que al final las determina. Dentro de ese marco económico el hombre desarrolló la idea de comercio, a partir de la producción y los excedentes o productos sobrantes se generaron la idea de comercializarlos con otras comunidades. Allí nace el comercio como tal, pero la idea de comerciante nace como aquel intermediario entre el productor que no puede transportar la mercancía y el comprador que espera la llegada, esa profesión se fue especializando de acuerdo a los valores primarios como la tierra, la maquinaria, o el capitalismo, en cada estadio histórico de la humanidad. El comercio actual abrió sus fronteras a una nueva visión, la cual tiene que ver con la especialización industrial, y el fortalecimiento del mercado de los bienes y servicios; pero la modernidad no solo trajo nuevas modalidades comerciales, sino que produjo el desarrollo de la informática y las telecomunicaciones, el cual permitió ampliar la expectativa de los mercados para las empresas, y la generación de nuevas relaciones comerciales entre los seres humanos, a través de lo que se denomina Comercio Electrónico. El Comercio Electrónico, a la vez que modernizó la manera de vender y comprar productos, le trajo nuevos retos al derecho, especialmente en las nuevas relaciones de riesgo nacidas al comercializar productos en Internet, en Colombia esos retos empezaron a plasmarse en la Ley 527 de 1999, la cual, tomada del modelo de la Organización de las Naciones Unidas, al igual que muchas, dejo temas al azar y carentes de profundización, de allí nace el deseo a través de esta Monografía de establecer la situación real de la legislación colombiana en el tema del Comercio Electrónico, comparándola con la situación de otros países, pero a la vez proponer estrategias que puedan ser utilizadas en el desarrollo legislativo sobre el tema, y que ellas permitan, en un futuro no muy lejano reglamentar de manera clara y adecuada las relaciones comerciales en Internet. | |
| dc.description.abstractenglish | The development of the human being had implicated the perfection of the relations that this one sustain with other beings of its own specie, directing them through the Law but according to a base called Economics; that is the base that has modified the human relations, because is this the one that leads in the end. Inside this economical environment, man developed the commerce, from the production and what they have left from it came the idea of dealing with it between other communities. There is where the commerce idea was born as it, but the idea of the retailer was born as the person between the one that can not transport the merchandise and the buyer that waits for it to arrive, that profession had been getting specialized according to the primary values as the earth, the machinery, or the capitalism, on each historical field of the humanity. The commerce nowadays opened its frontiers to a new vision, which has to be with the industrial specialization and the fortification of the products and services market; but the modernity not only brought new commercial modes, but it produced the development of informatics and telecommunications, which allowed opening up the market expectative for firms, and the generation of new commercial relationships between human beings, through all it is known as Electronic Commerce. The Electronic Commerce, at the same time that modernized the way of selling and buying products, it brought new challenges to the Law studying, especially in the new risk relations born by dealing with products on the Internet, in Colombia those challenges started to shape it selves in the Law 527 of 1999, which, taken from the United Nation Organization model, as well as some others, left a lot of topics up on the air and with a little bit of deepening, from there was born through this monograph the establishment of the real situation of Colombian legislation regarding Electronic Commerce, comparing it with other countries situation, but at the same time to propose strategies that can be used in the legislative development in the subject, and let them allow, on a non distanced future rule on a clear way and adapted the commercial Internet relations. | |
