dc.description.abstractEsta investigación cuestiona y analiza la eficacia del derecho internacional en la protección de los derechos humanos del pueblo palestino, a partir del conflicto originado el 07 de octubre de 2023. Para ello, se examinan los principales organismos e instrumentos jurídicos del derecho internacional público, al igual que los tratados internacionales que configuran las graves violaciones de derechos humanos, con énfasis especial en los crímenes de genocidio y de lesa humanidad. Así mismo, se estudian los pronunciamientos de los organismos internacionales con facultades jurisdiccionales como también los pronunciamientos de los organismos principales del sistema internacional sin facultades jurisdiccionales, frente al reciente conflicto en Palestina, evaluando su alcance y su efectividad en la aplicación de las normas internacionales para salvaguardar al pueblo palestino. El capítulo final de esta investigación analiza la incapacidad del derecho internacional público, como garante de la paz y la seguridad global, en detener el genocidio en Gaza, pues pese a contar con los instrumentos jurídicos necesarios y, contar con los órganos competentes para implementarlos, debido a la influencia de las grandes potencias en el sistema internacional, continúan las graves violaciones de derechos humanos en Palestina sin una respuesta contundente por parte de la comunidad internacional, siendo un claro reflejo de la teoría neorrealista de Waltz.
dc.description.abstractenglishThis research questions and analyzes the effectiveness of international law in the protection of the human rights of the Palestinian people, starting from the conflict originated on October 7, 2023. To this end, it examines the main bodies and legal instruments of public international law, as well as international treaties that shape the serious violations of human rights, with special emphasis on crimes of genocide and crimes against humanity. It also studies the pronouncements of international bodies with jurisdictional powers as well as the pronouncements of the main bodies of the international system without jurisdictional powers, in the face of the recent conflict in Palestine, evaluating their scope and effectiveness in the application of international norms to safeguard the Palestinian people. The final chapter of this research analyzes the inability of public international law, as guarantor of peace and global security, to stop the genocide in Gaza, because despite having the necessary legal instruments and the competent bodies to implement them, due to the influence of the great powers in the international system, serious violations of human rights continue in Palestine without a forceful response from the international community, being a clear reflection of Waltz's neo-realist theory.
