dc.description.abstractEl derecho disciplinario como rama que busca prevenir y corregir la conducta contraria de los servidores públicos, trabajadores oficiales y particulares que ejercen función pública, ha tenido grandes avances en los últimos años debido a la expedición por parte del legislador de un nuevo Código General Disciplinario que trajo consigo cambios sustanciales y complemento los vacíos normativos del derogado Código Disciplinario Único del año 2002. Por supuesto, esta nueva normativa fue la respuesta a los planteamientos de juristas que venían reclamando desde la expedición de la Constitución de 1991, la autonomía e independencia de esta rama del derecho por sobre otras especies del derecho sancionador, dado que por mucho tiempo el derecho disciplinario fue considerado como un apéndice del derecho penal. Ahora, es conforme a esta corriente que se pretende brindar un apoyo jurídico a la Oficina de Control Interno Disciplinario de la Universidad Industrial de Santander, en lo que respecta a la revisión de expedientes y proyección de cada uno de los autos que intervienen en la fase de investigación hasta la formulación del pliego de cargos, proceso que requiere saber analizar las noticias disciplinarias que son remitidas ante esta dependencia administrativa. Por consiguiente y para dar cuenta del cumplimiento de los objetivos propuestos en el tiempo de duración de la práctica jurídico social, se elaboró mensualmente un informe que puso de presente las actividades desarrolladas bajo la tutoría y guía de la profesional de la Oficina de Control Interno Disciplinario. Finalmente, el presente trabajo fue una oportunidad de aplicar los conocimientos teóricos de la materia de derecho disciplinario llevados a la práctica jurídica y al devenir cotidiano procesal, pues si bien existe normativa de rango legal que puede dar pautas para el análisis de una noticia disciplinaria, también lo es que ciertos casos suelen presentar circunstancias particulares que dificultan su proceso de evaluación, para lo cual, es necesario del uso constante de la dogmática como forma de racionalizar y dar una solución que garantice los derechos de los sujetos procesales.
dc.description.abstractenglishDisciplinary law as a branch that seeks to prevent and correct the contrary conduct of public servants, official workers and individuals in public service have made great progress in recent years due to the issuance by the legislator of a new General Disciplinary Code that brought about substantial changes and complemented the regulatory gaps of the repealed Single Disciplinary Code of 2002. Of course, this new regulation was the answer to the proposals of jurists that had been demanded since the issuance of the 1991 Constitution, the autonomy and independence of this branch of law over other species of sanctioning law, since for a long time disciplinary law was considered an appendix of criminal law. Now, it is in line with this trend that it is intended to provide legal support to the Office of Internal Disciplinary Control of the Industrial University of Santander, as regards the projection of each of the documents involved in the investigation phase to the formulation of the statement of objections, process that requires to know to analyze the disciplinary news that are forwarded to this administrative unit. Consequently, and to account for the fulfillment of the proposed objectives during the duration of the social legal practice, a monthly report was prepared that highlighted the activities carried out under the mentoring and guidance of the professional from the Office of Internal Disciplinary Control. Finally, the present work was an opportunity to apply the theoretical knowledge of the matter of disciplinary law taken to legal practice and to the daily procedural evolution, because although there are regulations of legal rank that can give guidelines for the analysis of disciplinary news, It is also true that certain cases usually present particular circumstances that make their evaluation process difficult, for which it is necessary to constantly use dogmatics as a way to rationalize and provide a solution that guarantees the rights of the procedural subjects.
