dc.description.abstractEn el presente trabajo de investigación se analiza la concepción iusfilosófica de Jürgen Habermas frente al método de la ponderación propuesta Robert Alexy en su Teoría de Derechos Fundamentales, dentro del marco de la argumentación jurídica y práctica. Partiendo de la Teoría de Ronald Dworkin, influenciada por la deontología de Rawls, y de la exposición de la tesis de la Ponderación de Robert Alexy, con tintes axiológicos en su postura; se reconstruye el aporte iusfilosófico habermesiano frente a la ponderación como método de interpretación constitucional, que desarrolla en su obra Facticidad y Validez dirigida a tres aspectos cruciales en la ponderación: La irracionalidad del método, la corrección y la justificación. Estas tres críticas llevan a Habermas a afirmar que la ponderación cae fácilmente y de manera inevitable en la subjetividad por parte del juez al resolver un caso difícil teniendo en cuenta juicios valorativos. Por tanto, al considerar los derechos fundamentales o principios constitucionales como valores, dejan a un lado su naturaleza deontológica de normas.
dc.description.abstractenglishIn the present research work, the philosophical conception of Jürgen Habermas is analyzed against Robert Alexy's proposed method of weighting in his Theory of Fundamental Rights, within the framework of legal and practical argumentation. Starting from the Theory of Ronald Dworkin, influenced by the deontology of Rawls, and the exposition of the thesis of Robert Alexy's Weighting, with axiological overtones in his position; the Haussmannian iusophosophical contribution is reconstructed in the face of weighting as a method of constitutional interpretation, which develops in its work Facticity and Validity directed to three crucial aspects in the weighting: The irrationality of the method, the correction and the justification. These three criticisms lead Habermas to affirm that the weighting falls easily and inevitably into subjectivity on the part of the judge when solving a difficult case taking into account evaluative judgments. Therefore, when considering fundamental rights or constitutional principles as values, they leave aside their deontological nature of norms. 3
