dc.description.abstractEl artículo 3º de la Ley 1562 de 2012, define accidente de trabajo como “todo suceso repentino que sobrevenga por causa o con ocasión del trabajo, y que produzca en el trabajador una lesión orgánica, una perturbación funcional o psiquiátrica, una invalidez o la muerte”. A partir de tal definición, el artículo 62 del Decreto 1295 de 1994 establece al empleador la obligación de reportar el accidente de trabajo ante la aseguradora de riesgos laborales y la entidad prestadora de salud, para que estas brinden las prestaciones sociales y económicas necesarias para la rehabilitación integral del trabajador. Sin embargo, frecuentemente se presentan accidentes que no son reportados por el empleador generando graves afectaciones al trabajador. Por tal razón, el legislador adopta la Resolución No. 0156 de 2005 y la Resolución No. 1570 de 2005, la cuales facultan al trabajador para realizar el reporte de accidente de trabajo por aviso ante las respectivas entidades, lamentablemente muy pocos trabajadores conocen dicha normatividad. En ese contexto, surge la presente practica jurídico social que se desarrolla a través de un acompañamiento jurídico virtual a los trabajadores adscritos al Centro de Atención Laboral Villavicencio, con el propósito de investigar esta problemática y brindar herramientas que permitan a los trabajadores realizar el reporte de accidente de trabajo por aviso para la defensa de sus derechos fundamentales.
dc.description.abstractenglishThe Article 3 of Law 1562 of 2012 defines occupational accident as "any sudden event that occurs due to or in connection with work, and that produces in the worker an organic injury, a functional or psychiatric disturbance, a disability or death". Based on this definition, the article 62 of Decree 1295 of 1994 establishes the employer's obligation to report the work accident to the labor risk insurance company and the health care entity, so that they may provide the necessary social and economic benefits for the integral rehabilitation of the worker. However, accidents frequently are not reported by the employer, generating serious damages to the worker. For this reason, the legislator adopts the Resolution No. 0156 of 2005 and Resolution No. 1570 of 2005, which empower the worker to report the work accident by notice to the respective entities, unfortunately very few workers are aware of these regulations. In this context, this social legal practice is developed through a virtual legal accompaniment to workers attached to Villavicencio’s Job Care Center, in order to investigate this problem and provide tools that will allow workers to make the accident report by notice for the defense of their fundamental rights.
