dc.description.abstractDentro del presente trabajo se pretende realizar un análisis a las medidas jurídicas que posee la empresa de servicios públicos domiciliarios Aguas de Barrancabermeja S.A E.S. P para aplicar al delito de defraudación de fluidos. La primera que se considera de tipo administrativa a través de la Ley 142 de 1994, por la cual se estableció el régimen de prestación de servicios públicos domiciliarios, la cual permite efectuar mecanismos con el fin de recuperar los metros cúbicos dejados de facturar por la Empresa. En materia penal, el delito fue tipificado por la ley 599 de 200 en su artículo 256 (Actual Código Penal), lo que significa que no existía de tal forma en legislaciones anteriores de manera autónoma. Esta conducta, en líneas generales, trata sobre la apropiación de energía eléctrica, agua, gas natural o señal de telecomunicación mediante cualquier medio clandestino. Finalmente, se efectúan una serie de recomendaciones con el fin de mejorar las medidas que se deben tomar a la hora de realizar la captación del material probatorio usado dentro de los respectivos procesos jurídicos y, además, las adaptaciones requeridas en el debido proceso del Manual de Defraudación de Fluidos de la Entidad en el marco del decreto 806 del 2020. Dicho lo anterior, se presentará una compilación de la totalidad de los informes realizados durante la ejecución de la práctica empresarial, donde en un primer momento se explicarán los aspectos básicos necesarios para entender el contexto en que se realiza dicho análisis. Seguidamente se traerá a colación el marco jurídico que abarca el delito de defraudación de fluidos y finalmente, se procederá a determinar cuál es la medida jurídica más efectiva que puede aplicar Aguas de Barrancabermeja S.A E.S.P.
dc.description.abstractenglishWithin the present work, it is intended to carry out an analysis of the legal measures that the home public services company Aguas de Barrancabermeja S.A E.S. P to apply to the crime of fluid fraud. The first, which is considered to be of an administrative nature through Law 142 of 1994, by which the regime for the provision of residential public services was established, which allows mechanisms to be carried out in order to recover the cubic meters not invoiced by the Company. In criminal matters, the crime was typified by Law 599 of 200 in its article 256 (Current Penal Code), which means that it did not exist in such an autonomous way in previous legislation. This conduct, in general terms, deals with the appropriation of electricity, water, natural gas or telecommunication signal by any clandestine means. Finally, a series of recommendations are made in order to improve the measures that must be taken when capturing the evidentiary material used within the respective legal processes and, in addition, the adaptations required in the due process of the Manual of Fraud of Fluids of the Entity within the framework of decree 806 of 2020. That said, a compilation of all the reports made during the execution of the business practice will be presented, where at first the basic aspects necessary to understand the context in which said analysis is carried out will be explained. Next, the legal framework that covers the crime of fluid fraud will be brought up and finally, the most effective legal measure that Aguas de Barrancabermeja S.A E.S.P. can apply will be determined.
