dc.description.abstractEl trabajo plantea como hipótesis “El paradigma del positivismo jurídico de los estudiantes de la Facultad de Derecho de la Universidad Cooperativa de Colombia Seccional Bucaramanga, provienen en parte de factores internos en el desempeño de los procesos de pensamiento lógico, racional y analítico. El pensamiento lógico-racionalista del estilo de aprendizaje de los estudiantes de la facultad de Derecho se refuerza con el paradigma positivista disyunto que impide un pensamiento complejo en la interpretación jurídica, por ello, se propone un currículo que profundize la naturaleza hermenéutica en el Derecho y reoriente el estudio de casos desde un pensamiento complejo que fundamente el modelo dialogal de los diferentes paradigmas en el Derecho que son aprendidos por el mismo estudiante de la UCC de Bucaramanga. La metodología y las técnicas empleadas en la investigación evidenciaron las tendencias que existen en los estilos interpretativos y su relación con procesos de pensamiento logrando un diagnostico previo antes de enseñar cualquier corriente o teoría de la interpretación jurídica o del Derecho, con el fin de poder diseñar un currículo que promueva un estudiante competente desde la crítica frente a los paradigmas reinantes en el Derecho y en la naturaleza del pensamiento. Esto debe generar un acompañamiento constante en cada uno de los diez semestres cursados en la carrera de Derecho; cuestión que exigiría que la Hermenéutica Jurídica no fuera de un semestre sino que implicara una transversalidad curricular.
dc.description.abstractenglishThe work raises as hypothesis " The paradigm of the juridical positivism of the students of the Faculty of Law of the Cooperative University of Sectional Colombia Bucaramanga, they come partly from internal factors in the performance of the processes of logical, rational and analytical thought. The thought logician - rationalist of the style of learning of the students of the faculty of Law is reinforced by the positivist separated paradigm that prevents a complex thought in the juridical interpretation, for this reason, one proposes a curriculum that profundize the hermeneutic nature in the Law and it reorientates the study of cases from a complex thought that the model bases dialogic of the different paradigms on the Law that they are learned by the same student of Bucaramanga's UCC. The methodology and the technologies used in the investigation demonstrated the trends that exist in the interpretive styles and his relation with processes of thought achieving a previous diagnosis before teaching any current or theory of the juridical interpretation or of the Law, in order to be able to design a curriculum that a competent student promotes from the critique opposite to the reigning paradigms in the Law and in the nature of the thought. This must generate a constant accompaniment in each of ten semesters dealed in the career of Law; question that would demand that the Juridical Hermeneutics not out of a semester but it was implying a transversalidad curricular.
