dc.description.abstractDurante el desarrollo de la práctica jurídico social llevada a cabo en el Centro de Atención Laboral de Villavicencio, se evidenció la recurrente problemática que presentaban los usuarios del sector de la palma de aceite, quienes padecían afecciones a su salud física y mental; y se veían desmejorados o afectados en sus relaciones laborales en virtud de su condición de salud. Es por esto, que en el presente trabajo se pretende plasmar el sustento normativo con el que cuentan los trabajadores y trabajadores de este sector industrial, para ejercer plenamente sus derechos y evitar vulneraciones a los mismos. Para esto, se pretende identificar los requisitos con los que debe contar un trabajador, conforme al ordenamiento jurídico colombiano, para ser amparado por el fuero de estabilidad laboral reforzada por debilidad manifiesta. Se evidenció que, en lo referente a la salud mental, si bien estas enfermedades afectan gravemente la vida de quien las padece, no se le da tal tratamiento, pues, por el contrario, existe una fuerte postura que pretende hacer caso omiso a las mismas, rezagándolas sin prestar mayor atención, por lo cual, se tocarán aspectos importantes en dicha materia con el fin de brindar las herramientas necesarias a los trabajadores. para hacer un uso efectivo de sus derechos.
dc.description.abstractenglishDuring the development of the social legal practice carried out at the Villavicencio Labor Care Center, the recurring problems presented by users of the oil palm sector, who suffered from physical and mental health conditions, were evidenced; and their labor relations were impaired or affected by virtue of their health condition. It is for this reason, that in the present work it is intended to capture the normative support that workers and workers in this industrial sector have, to fully exercise their rights and avoid violations of them. For this, it is intended to identify the requirements that a worker must have, according to the Colombian legal system, to be protected by the labor stability jurisdiction reinforced by manifest weakness. It is evident that, in relation to mental health, although these diseases seriously affect the life of those who suffer from them, such treatment is not given, because, on the contrary, there is a strong position that tries to ignore them . , leaving them behind without paying more attention, therefore, important aspects of this matter will be touched on in order to provide the necessary tools to workers to make effective use of their rights.
